New Hawaii Law Says
Homeowner Associations Must Allow Solar Energy Devices
Hawaii Governor Linda Lingle recently signed Act 157 (originally House
Bill 1017). The new law requires homeowner associations to adopt rules
that allow placement of solar energy devices on single-family dwellings
covered by an association.
The law was effectively immediately after Lingle’s signing of Act 157.
However, associations have until the end of next year to comply.
Homeowner associations sometimes have significant power to tell
individual homeowners what they can and can't do to their own property,
if the homeowners signed contracts agreeing to abide by homeowner
covenants. The Hawaii law was created to prevent homeowner associations
from banning solar energy devices.
