Fenoc target of federal jury investigation

Washington (Platts)--13Dec2004

FirstEnergy Nuclear Operating Co. (Fenoc) was informed by the U.S. Attorney's
Office that it is the "target of a federal jury investigation into alleged
false statements made" to the NRC in 2001 related to the extended outage of
Davis-Besse, parent FirstEnergy Corp. said today. The letter notifying the
company that it was the target of the grand jury probe also said that
prosecutors believe "federal charges will be returned" against the company by
the grand jury. In late 2003, Fenoc said it received a grand jury subpoena
requesting the production of certain documents and records relating to the
inspection and maintenance of the reactor vessel head at its Davis-Besse
Plant. The documents and materials were provided to the grand jury sitting in
the U.S. District Court for the Northern District of Ohio, Eastern Division.
NRC gave Davis-Besse permission to restart in March, after the reactor had
been out of service for two years following the discovery of severe boric acid
corrosion on the reactor vessel head.
