EPA denies states´ requests to reconsider nonattainment status

The federal government has denied petitions from five states and local governments and one private business asking the Environmental Protection Agency to reconsider its declarations of specific areas as being in nonattainment for fine particle pollution.

The petitions were filed by West Virginia, concerning a portion of Mason County in the Huntington area; Georgia, pertaining to the inclusion of Walker and Catoosa counties; Michigan, pertaining to the inclusion of Wayne County; Oakland County, Mich., pertaining to its inclusion in the Detroit-Ann Arbor nonattainment area; Ohio, pertaining to the inclusion of Scioto, Adams, Gallia and Lawrence counties; and Dynegy Midwest Generation, pertaining to the inclusion of a portion of Randolph County.

Areas designated as being in nonattainment can still receive federal highway funds. However, nonattainment areas must reduce emissions that produce fine particles and pollutants in an effort to attain the quality standards.
