Lawsuit targets refinery

June 18 An environmental justice activist is suing the federal government over new rules that allegedly allow refineries to flare excess gases for hours at a time, emitting toxic pollution over neighborhoods. Jesse N. Marquez and the Coalition for a Safe Environment, who are being represented by Earthjustice, filed the lawsuit in the U.S. District Court for the District of Columbia. The lawsuit alleges a U.S. Environmental Protection Agency rule change allows oil refineries to operate without adequate startup, shutdown and malfunction plans, which leads to excess flaring. The "Startup, Shutdown and Malfunction" rule change also blocks public access to information about specific oil refinery toxic emissions and public safety plans, according to the lawsuit.
