We recently won an exciting legal victory over the US Food and Drug
Administration. A federal judge found that the FDA had
unconstitutionally suppressed ten credible health claims about the
benefits of selenium—that they had infringed on the free speech rights
of natural health product manufacturers!
This success is not ours—it is yours. We exist only through your
activism and your financial support. We are tremendously grateful to our
members.
Today we’re writing about two pressing matters.
The first is that we need to launch an an education campaign this
summer, before Congress adjourns. We need to get the word out—both to
the public and to our legislators—that a grievous lie is being
perpetrated by the media, Big Pharma, and the FDA.
They’re saying that dietary supplements are unregulated, and that
further controls and limitations on them are justified. This is nothing
short of an attack on the very supplements you and your family use to
maintain and strengthen your health.
The truth is, the FDA already has complete power to regulate
supplements, using three different tools:
The FDA may remove any unsafe, misbranded, or adulterated supplements
from the market.
It is charged with enforcing the 1994 Dietary Supplement Health and
Education Act (DSHEA), which holds supplement manufacturers to the “good
manufacturing practices” (industry standards for product quality) which
the FDA itself defined.
It collects reports and takes any necessary action on “adverse events”
(reported negative reactions to dietary supplements).
They’re perpetuating the lie in order to justify legislation that would
greatly expand the powers of the FDA and Federal Trade Commission to
reduce affordable access to dietary supplements. And we need your
donations in order to launch that education campaign right away.
Congress is scheduled to adjourn for the summer on August 9.
Here’s the second matter: On the heels of our recent victory in court,
our legal coffers are running low. It is likely the FDA will appeal our
win. And we still await the ruling in last year’s lawsuit, in which we
sued the FDA to stop suppressing health claims for vitamins C and E—that
they are powerful antioxidants.
Because we need to use the court system to fight the FDA over scientific
freedom of speech, we also need your financial contribution to our legal
fund.
