Sierra Club loses appeal over waste water disposal

The Nevada Supreme Court said today that the Sierra Club sued the wrong state agency in its challenge over waste water disposal at the Reid Gardner power plant in Southern Nevada.

The Sierra Club objected to the renewal of a permit for NV Energy to discharge waste water from the coal-fired plant into evaporation ponds.

The Nevada State Environmental Commission rejected a claim by the Sierra Club that the system caused underground pollution.

The club sued the state's Environmental Protection Division, which recommended approval for a five-year extension of the waste water permit.

But the court said the Sierra Club failed to sue the commission, which made the final decision. It said the Sierra Club could amend its petition to include the commission because a 30-day deadline passed.
